Allihoop Terms & Conditions

TERMS AND CONDITIONS
By booking and rendering payment for services to Allihoop, you are entering a legally binding agreement as set out below (the “Agreement”). The Agreement comes into effect once Allihoop has received and confirmed payment for the service. This Agreement sets out the terms, conditions and obligations that the Guest agrees to when booking a stay or service through Allihoop.

DEFINITION OF TERMINOLOGY

The Guest
refers to the individual booking the service and/or staying at an Allihoop location. 
Allihoop refers to Allihoop Group AB, Regeringsgatan 29, 11153 Stockholm, Registration number 559234-5887.
Arrival Date refers to the date when the Guest starts the Stay Period.
Departure Date refers to the Departure Date of the Stay Period by which the Guest shall have vacated the premises, unless another agreement with Allihoop has been made.
Stay Period  refers to the total period of time that the Guest has access to the Studio under the Agreement.
Community Member(s) refers to individuals that have access to a Studio in an Allihoop location, including the Guest upon signing the Agreement.
The Studio  refers to a private room within an Allihoop location, allocated to the Member for the Commitment Period. Studios may vary in size, layout, and features depending on the Studio type selected. The specific room number is not guaranteed, and Allihoop may reassign the Member to another Studio of the same type within the Community Location.

FEES
When booking a service through  Allihoop, you are agreeing to pay the charges specified in conjunction with the service and applicable fees detailed in this Agreement through the payment methods provided by Allihoop. Amounts are written in SEK and inclusive of applicable VAT.

CODE OF CONDUCT
Allihoop community experience is based on mutual respect and responsibility between the Guest, Allihoop and other guests/Community Members. You are responsible for taking reasonable care of both the Studio provided to you and the shared facilities, as well as respecting other Community Members.

By booking a stay with Allihoop, the Guest agrees to comply with the Code of Conduct and the relevant building rules and community guidelines and to keep up to date with them. The Guest understands that failure to comply with these rules and guidelines, or to remedy their conduct within a reasonable time frame if provided with a warning by Allihoop, may result in immediate termination of any services provided by Allihoop.

The Guest agrees to comply with any future changes to the above specified policies for the duration of their Stay Period.

ELIGIBILITY AND ACCESS
Bookings and access to Allihoop Studios and Community Locations are limited to individuals who are 18 years or older. Minors are not permitted to book, hold a Membership, or be provided independent access to the premises. Members may not host minors as guests in their Studio or in any shared spaces.

DELIVERY OF SERVICES
Allihoop will provide the Guest with access to the Type of Studio as is stated at the time of booking for the full Stay Period, excepting extenuating circumstances beyond Allihoop’s control or the termination of the service. The Guest acknowledges that conditions of Allihoop’s facilities may vary, and that the condition, design and style of the various spaces  and its inventory cannot be guaranteed. If objects or fixed interiors of the Studio or its inventory is damaged or otherwise non-functional, either upon the Guest first gaining access to the Studio or during their Stay Period, the issue(s) must be reported promptly and without any delay to Allihoop by sending an email to community@allihoop.se.

Allihoop commits to make reasonable efforts to remedy the issue(s) and to maintain the function of any item(s) or essential systems included in the given space. If maintenance of the previously mentioned item or system is not possible, Allihoop  will replace it to ensure the associated functionality. It is up to Allihoop’s discretion to re-allocate the Guest to another Studio within the same building during the Stay Period, subject to sufficient lead time.

BOOKING TERMINATION
By the Guest
The Guest may terminate a booking at any time by submitting a written notice to Allihoop by email (community@allihoop.se), or through submission of the relevant termination notice form if the Stay Period exceeds 60 days. The Guest acknowledges that termination of a booking does not relieve the Guest of the obligations outlined in this document, and that compensation for the booked services and associated charges/fees still need to be rendered appropriately.

Allihoop is not required to refund any previously rendered payment for the terminated services, and may still claim compensation for damages or other charges required to reset the Studio to an equivalent condition as before the Stay Period.

By Allihoop
Allihoop reserves the right to terminate bookings at any time. Termination by Allihoop will always be preceded by a formal notice of Agreement termination being sent to the Guest, stating the reason for termination and the date by which the Guest will be required to have vacated the Studio.

 Allihoop reserves the right to immediately terminate the Agreement before the agreed End Date, including under the following circumstances:
1. The Guest has violated the Community guidelines or otherwise behaved improperly to other Community Members or Allihoop staff.
2. The Guest has compromised the safety of other Community Members or placed other Community Members at risk. 
3. The Guest has caused unreasonable damage to Allihoop’s property or has been determined to pose a risk to do so in the future.

In the case where no notice is given by either party mentioned in these terms, this agreement will end on the Departure Date.

INSURANCE
Allihoop maintains insurance coverage for the booked Studio and its included furniture and inventory. As the Guest’s  personal belongings are not covered by Allihoop’s insurance, the Guest is responsible for arranging appropriate insurance for any personal items kept in the Studio or shared spaces in the building. The Guest acknowledges that Allihoop is not responsible for compensating or replacing personal property in the case of damages, theft or loss during the Stay Period.

INVENTORY, FURNITURE & TECHNICAL APPLIANCES
The Guest is responsible for taking care of the Studio, its inventory and the associated furniture during the Stay Period, meaning that any wear should only be the result of regular and non-damaging use. The Guest may not make any permanent or damaging modifications to the studio.

In the event of issues related to piping, water access, electricity, heating, or technical appliances, the Guest may not attempt any repair themselves and should instead notify Allihoop immediately. However, the Guest is liable to take measures to minimize the damage, e.g. turn off the water, until necessary maintenance can be rendered. If the Guest has caused the issue through direct action, the Guest may be held  responsible for the repair cost.

ACCESS TO STUDIO
Representatives of Allihoop may enter the Studio at reasonable times for inspections, maintenance, or to address emergencies, and without prior notice if urgent. 

KEYS & ACCESS
Any keys and codes that the Guest will need to use to access the relevant spaces will be made available to them on or before their Arrival Date and the necessary instructions on how to access these will be provided when necessary. If lost or damaged, the keys may be replaced for a fee of 1000 SEK (incl. VAT). In case the Guest fails to return the keys at the end of their stay, the same fee may be deducted from the Guest’s service retainer if one has been paid, or charged separately. This fee covers the replacement of 1 physical key and up to 2 key cards.

Arrival Date
Instructions regarding the process of gaining access to the Studio and verifying its condition and inventory will be provided to the Guest via e-mail before the Arrival Date. The Studio will be available to the Guest from 15:00 (3pm) on the Arrival Date. 

Departure Date
It is the Guest’s responsibility to ensure that the Studio is in the same condition as it was received at the beginning of the Stay period, excepting any changes done by Allihoop and reasonable wear of the Studio’s inventory. 
The Guest shall ensure that any keys that can be used to access the Studio or spaces in the building have been returned by 11:00 (11am) on the Departure Date, in accordance with the instructions provided by Allihoop. 
In case the Studio is not vacated by the Guest by 11:00 (11am) on the specified Departure Date, Allihoop reserves the right to charge a late check-out fee of 2000 SEK per day including applicable VAT until the Studio has been vacated.

THIRD PARTIES
The Guest may not provide direct, independent access to the Studio to a third party during the Stay Period, nor seek to profit off the Studio or building facilities outside of the Guest's personal use of these.

The Guest shall also notify Allihoop if they intend to host another person in their Studio for more than 3 days, whether concurrently or in instances, as this individual may need to be considered an additional Community Guest by Allihoop. Allihoop  reserves the right to deny such stays. 

The Guest is liable for their guest(s) actions, and is held responsible for their conduct and/or any damages caused by them. 

GENERAL PAYMENT TERMS
Payment is made in conjunction with the booking, and must be completed for the booking to be considered valid. No access will be provided until payment has been received in full. All payments are non-refundable except as expressly provided for in this Agreement or required by law.

PAYMENT METHODS

The payment service Stripe is used by Allihoop to receive payment for bookings.
Errors or issues that arise during the payment process are not the responsibility of Allihoop, but action may be taken by Allihoop  to correct issues such as overdrafting if reported within a reasonable timeframe. 

The Guest may request alternate methods of payment (e.g., by invoice), but Allihoop is under no obligation to approve such requests. The Guest may contact Allihoop to inquire about such alternate methods of payment, such as by invoice, but Allihoop is not obliged to acquiesce to such requests.

 STAY PERIOD
The dates specified during the booking process signify the earliest date from which the Guest can access the Studio and building (Arrival Date) and the date by which the Guest is obligated to vacate the building (Departure Date) unless altered by subsequent Agreements between the parties or by the process of booking termination as specified in these terms.

OTHER PROVISIONS
Allihoop is not liable for delay or non-delivery of services caused by an impediment beyond its reasonable control, provided further that Allihoop could not have reasonably foreseen such impediment when agreeing to the booking and that such impediment cannot be overcome or avoided with reasonable cost and effort (force majeure). 

The following incidents always constitute a force majeure: water damage, accident, fire, strike, natural catastrophe, interruption in energy supply, power outage, water or sewage problems, heating problems, pandemics, war, and restrictions relating to pandemics, authority decisions relating to the Studio, Internet connection interruptions, and repairs, servicing, and other similar work performed by third parties. Force majeure affecting a partner or subcontractor of Allihoop shall similarly release Allihoop from liability.

If, due to legislative changes, regulations imposed by the authorities or other reasons, any provisions of the Contract are or become invalid or null, the other parts of the agreement shall continue to be in effect, and the parties have an obligation to negotiate a solution that meets the original purpose and balance of obligations and liabilities between the parties.

When making a booking, the Guest is required to provide an address for the delivery of any notifications concerning the booking. While the agreement is in effect, Allihoop may send the Guest and the Guest staying at the Studio service notifications, such as updated information about their booking, by e-mail and text message. The Guest may refuse the delivery of such notifications, though in doing so accepts responsibility for issues that may arise as a consequence of missing this information.

Unless expressly otherwise agreed or indicated by Allihoop, the Accommodation Services are provided by – and the service provider party to the agreement is – Allihoop entity operating in the country where the Studio is located. The details of the relevant Allihoop entity are set out in the Booking Confirmation.

Allihoop shall have the right to assign its rights and obligations under these Terms & Conditions to any of its group companies or to a third party that acquires the relevant business pertaining to these Terms & Conditions.

USE OF IMAGES AND LIKENESS
Allihoop may come to photograph, film, or otherwise capture the Guest’s image and likeness during community events, in shared spaces, or in connection with Allihoop activities. Such images may be used for internal and external purposes, including but not limited to online advertising, placement on Allihoop’s website, printed materials, and social media channels. By agreeing to these terms and conditions, the Guest approves of this use. The Guest can withdraw this consent at any time by notifying Allihoop in writing at community@allihoop.se. Allihoop will respect the Guest’s preferences from the date such notice is received.

CHOICE OF LAW & DISPUTE RESOLUTION
The contractual relationship between Allihoop and the Guest shall be subject to the laws and regulations applicable in the country where the Studio is located (or other Services provided), excluding any choice of law principles or practices. Any dispute, controversy, or claim arising out of or relating to the Contract, or the breach, termination, or validity thereof, shall be subject to the sole and exclusive jurisdiction of public courts having jurisdiction in the country where the Studio is located. 

If the Guest is a business or other non-consumer, Allihoop may, at its discretion, refer the dispute to be finally resolved by arbitration (skiljeförfarande) administered by the Arbitration Institute of the Stockholm Chamber of Commerce (SCC), with one arbitrator and in accordance with the SCC Rules for Simplified Arbitration. The place of arbitration shall be Stockholm, Sweden. The language of the arbitration shall be English unless otherwise agreed.

If the Guest is a consumer, arbitration may only be used if both parties agree to it after the dispute has arisen.See the National Board for Consumer Disputes (Allmänna reklamationsnämnden (ARN)) for further information. arn.se.In case of cross-border situations within the European Economic Area, you may seek advice from the European Consumer Centres Network (see eccnet.eu).

Appendix 1 - Code of Conduct
Cleaning
Take care of the space, inventory and maintain a tidy standard.
Please note: Smoking is not permitted anywhere inside buildings operated by Allihoop.

Shared Space
Throw away your trash, wash your dishes, wipe down surfaces and put away items that you may have used while in the shared spaces, to ensure that the space and inventory is ready to be used by other Community Members.
Feel free to move furniture around in the shared spaces to suit your needs, but put them back after they’ve been used so the space remains in an easily usable state.
If you participate in an event, assist the other participants in cleaning up the space afterwards.

Your Studio
Ensure that your Studio is kept in a condition that does not cause severe wear or damage to the furnishings or surfaces.
Avoid leaving out food, in order to avoid insects or other pests entering the Studio.
Avoid causing strong odors, as these may stick to textiles or porous surfaces in the Studio.

Respecting Neighbors
Shared Spaces
Make an effort to use shared items in a way that does not damage them or render them dysfunctional, as this may affect other Community Members’ experience.
Respect the peace of other Community Members by making sure not to cause any excessive noise after 22:00. 
When inviting guests into the shared spaces, limit the number of guests to a maximum of 5, to ensure that the space is still usable by other Community Members.
Follow the specific instructions and rules posted by Allihoop, as these are there to ensure the safety and comfort of all Community Members and the functionality of the facilities.

Your Studio
Avoid causing excessive noise that may disturb other Community Members, or give advance notice to the Community Members in the Studios in near proximity to yours in case it is necessary.
Notify Allihoop as soon as possible in case you notice an issue in your Studio, as certain issues may be exacerbated if left unattended. 

Safety
If a Guest of the community or the guest of a Guest is behaving in a disrespectful, discriminating, or harassing way, or if you suspect illegal activity in or around Allihoop’s buildings, we ask that you report this immediately to the Allihoop team.
To ensure that our spaces are kept as safe as possible, do not allow outside people into the building. If you do not recognize an individual or they can not provide means to enter the building by themselves, ask them to contact either the Allihoop team or a Guest they are acquainted with to provide them with access.
Avoid triggering the fire alarm both in your Studio and in the Shared Spaces. This causes undue stress for other Community Members and may result in the fire department responding unnecessarily. Please note that repeated occurrences of false alarms may incur a cost of 3000 SEK, which the responsible Guest(s) will be required to pay for.

Monitoring & Enforcement
In order to maintain the standards outlined in our Code of Conduct, Allihoop has several security cameras set up in the Shared Spaces in our Bromma and Årsta locations.
In the event that a report is made by a Guest or our Spotless Crew of the Code of Conduct being violated in these spaces, a Guest of the Allihoop team will view the relevant part of the recorded footage to determine what occurred and which parties were involved.
In the event that one or more of the points in this Code of Conduct above are not followed by a Guest, Allihoop reserves the right to charge the Guest a fee of 500 SEK.
In case an item is broken or otherwise needs replacement as a result of a Guest using the item improperly, the associated costs of replacing the item may be charged to the Guest's next invoice or deducted from the Guest's service retainer.
